SERVICE AGREEMENT
Terms & Conditions
The conditions intended to govern access to the TallyPeak POS website, free trial and paid SaaS plans.
These are not yet finalized customer terms. The operator’s legal details, refund policy, cancellation and deletion procedures, support channels and effective date must be confirmed before these terms become binding.
1. Service and agreement
TallyPeak POS provides cloud-based point-of-sale, product and inventory management, reporting, business settings and eligible plan features. Access is subject to account registration, subscription eligibility and these terms once finalized and accepted.
The intended service operator is Aleric Peaks Ventures; the full registered identity, business address, designated contact information and final effective date must be verified before these terms can be accepted as a final customer contract.
2. Accounts and responsibilities
The business owner is responsible for accurate registration details, suitable staff permissions, safeguarding credentials and promptly removing access when employees leave. Users must be authorised to represent the businesses they create or manage.
You must not attempt to access another tenant's data, bypass usage limits, exploit vulnerabilities, upload unlawful content or disrupt the service. We may restrict access to protect customers or respond to misuse.
3. Trial and subscription plans
A newly created eligible business workspace receives a 14-day free trial of the Starter plan, without requiring card details. The free trial begins at workspace creation and ends when the recorded trial period expires. Trial eligibility is limited, and attempts to repeatedly obtain trials through duplicate accounts may be reviewed.
Starter is currently GH₵99 per month or GH₵990 per year; Business GH₵179 per month or GH₵1,790 per year; Pro GH₵299 per month or GH₵2,990 per year. Published plan features, staff, location and product limits are shown on the Pricing page. The specific plan in your workspace controls entitlement.
During the pilot, payment collection is not automated. Submitting a reference is only a request for verification and does not activate or extend service. An authorised administrator must approve confirmed payments. Automatic recurring billing is not active unless separately introduced and clearly disclosed.
4. Expiry, suspension and cancellation
When a trial or paid subscription expires, or an account becomes past due or suspended, TallyPeak may limit new sales and other protected operations while keeping existing records in the database. Access restoration requires the applicable approval or renewal.
We do not promise indefinite storage after account closure. Final account cancellation, export and deletion procedures must be confirmed in the approved retention schedule and communicated before public release.
5. Charges, refunds and payment disputes
Pricing is stated in Ghana cedis. Any additional taxes or charges required by law should be identified at the point of purchase or invoice. Customers should make payments only using approved instructions received directly from the service operator.
Refund and cancellation eligibility, any billing disputes process, and statutory consumer rights must be confirmed in the final commercial policy. Nothing in these draft terms is intended to restrict rights that cannot lawfully be excluded under Ghanaian law.
6. Business records and data ownership
You retain responsibility for the business records you submit to TallyPeak and confirm you have the rights and notices needed to process them. You authorise us and necessary service providers to host, process, protect and back up those records solely to supply and secure the service and satisfy lawful requirements.
Each business is responsible for its own bookkeeping, cash controls, product descriptions, tax settings, customer communications, consumer rights and other regulatory obligations. TallyPeak reports depend on the accuracy and completeness of entered data.
7. Payment recording is not payment processing
Recording a cash, external Mobile Money, bank or card payment in TallyPeak does not itself transfer, verify, refund or settle money. You must independently confirm actual receipts and refunds outside the software. The operator does not promise payment-network connectivity that has not been enabled.
8. Availability, changes and support
We aim to maintain a reliable service, but interruptions, maintenance, provider outages and software defects may occur. Pilot features may change. Customers should maintain independent records or reconciliation procedures appropriate to the importance of their business operations.
Support channels, service-level commitments and any business-critical disaster recovery guarantees must be explicitly agreed rather than inferred from the existence of backups.
9. Intellectual property and restrictions
The software, product name, documentation and platform designs remain with their respective owners or licensors. An active subscription permits authorised use of the hosted service but does not transfer the underlying software or source code.
You may not resell the platform, reverse-engineer it in breach of law, scrape other accounts or use the service to facilitate fraud, malware or other unlawful activity.
10. Liability and governing law
Each party remains responsible for obligations that cannot lawfully be limited. Any commercial limitation of liability, remedies, dispute-resolution procedure and notice address must be reviewed and finalized by the operator's legal adviser.
These terms are intended for use by a Ghana-focused service and are expected to be governed by applicable Ghanaian law, subject to mandatory rights or overriding legal requirements.
11. Updates and contact
We will date the approved terms and notify users appropriately when material contractual changes take effect. Before accepting payments from the public, the final contact information and binding commercial terms must be accessible on this website.
Contact
The operator must provide its official contact email, physical address and business registration details before these terms are finalized. Check our Contact page for pilot status.
